Essay: The Attack on Small Busnesses

With respect to The State of California Air Resources Board (CARB) attack on small trucking companies and small construction companies:
 
On January1, 2010 CARB implemented new Diesel Regulations that require the owners of Heavy Duty Diesel Fueled Vehicles to replace the engine with a new (not rebuilt or overhauled) engine, or buy new 2010 model trucks..
 
The cost of the engine replacement was originally estimated to be approximately $30,000, however the actual cost is currently running at approximately $45,000 to $50,000.
 
Also, two high cost and high maintenance retrofits are required. The first is a Diesel Particle Filter (DPF) that was originally estimated to cost $10,000 but the actual cost is currently running approximately $15,000.
 
Also required is a Selective Catalytic Reduction device (SCR) This device was originally estimated to cost $10,000 but the actual cost is also approximately $15,000.
 
The actual total cost of the engine replacement and retrofits is currently approximately $80,000 for a Heavy Duty Diesel Fueled Truck.
 
Also, the owner is no longer permitted to do most of his or her own maintenance.
 
The owner must have the maintenance performed by a high cost mechanic who is certified by CARB. That further increases the costs for small trucking companies that do their own maintenance.
 
For most small trucking companies and small construction companies these costs are so high that it will put most of them out of business.
 
The large trucking companies have so much business that they wear out a truck in 2 to 3 years, so it is not much of a burden on the big trucking companies because they normally replace those trucks with new trucks in a short period of time.
 
The big trucking companies also benefit from the new Diesel Regulations because the new Diesel Regulations put the small trucking companies out of business.
 
The small trucking companies compete with the large trucking companies and keep the freight rates down through their competition with the large trucking companies.
 
Without the competition from the small trucking companies, the large trucking companies are free to raise their freight rates.
 
Higher freight rates increase the cost of all goods that are delivered by truck.
 
The cost of food, clothing and everything else that is delivered by truck will go up, because the cost to deliver those goods will go up if the small trucking companies are forced out of business by the new Diesel Regulations. 
 
Essentially, the burden of the new Diesel Regulations is much greater on the small trucking companies than it is on the large trucking companies..
 
The small trucking companies generally have much less business than the large trucking companies and normally drive a truck for 10 or 20 years before they have to replace the truck.
 
The small trucking companies do not have enough business that they can afford to pay $80,000 to retrofit an existing truck or buy a new 2010 model truck.
 
The same is true for small Construction companies that use equipment, like Road Graders which are also subject to the new Diesel Regulations.
 
The new Diesel Regulations are based on a fraudulent study by an employee of CARB.
 
That employee is Hien Tran, who claimed to have a PhD from UC Davis.
 
The study by Hien Tran said that fine particle matter from Diesel Exhaust was causing premature deaths.
 
This conclusion was in direct conflict with the research of Dr. James Enstrom, an Epidemiologist who has been a member of the faculty at the University of California at Los Angeles for over 34 years.    
 
Dr. Enstrom checked the academic credentials of Hien Tran and discovered that Hien Tran did not have the PhD that Hien Tran claimed to have from The University fo California at Davis.
 
Instead Hien Tran had purchased a piece of paper that said he had a PhD from a fraudulent organization that calls itself Thornhill University.
 
Dr. Enstrom reported the fraud by Hien Tran  to CARB.
 
The State of California investigated and determined that in fact Hien Tran did not have a PhD from UC Davis and that the PhD from Thornhill University was fraudulent.
 
As a result Hien Tran was suspended for 60 days and demoted.
 
Hien Tran is still employed by CARB.
 
Mary Nichols, the Attorney who is in charge of CARB was furious with Dr. Enstrom for exposing the fraud by Hien Tran.
 
Apparently CARB wanted the new Diesel Regulations and just wanted someone like Hien Tran to write a paper which looked scientific to justify the new Diesel Regulations.
 
Mary Nichols is also a member of the faculty at The University of California at Los Angeles Law school.
 
Mary Nichols convened a panel at The University of California at Los Angeles to fire Dr. Enstrom which I would say was in retaliation for Dr, Enstrom exposing the Hien Tran fraud at CARB.
 
Dr. Enstrom was fired from The University of California at Los Angeles effective August 30, 2010.
 
Dr. Enstrom is still at UCLA while he appeals the decision to fire him.
 
Steve Cooley, a candidate for Attorney General of the State of California has stated that if elected Attorney General he will investigate the fraud at CARB and the fraud by Hien Tran.
 
The opponent to Steve Cooley is Kamala Harris, a Radical Extreme Leftist who supports CARB.
 
It is very important that we elect Steve Cooley Attorney General so that he can investigate and prosecute the fraud at CARB and other agencies of The State of California.
 
I expect that the fraud at CARB is only the tip of the iceberg.
 
If this kind of fraud exists at one State Agency there is probably fraud throughout many other State Agencies.
 
The fraud at CARB not only costs the State of California over $1 Billion per year just to pay to run the agency, I estimate that the cost to the economy of the State of California for just the new Diesel Regulations is probably at least 20 to 30 Billion dollars per year in the form of higher prices, higher unemployment and lost production.
 
Also, I estimate that the new Diesel Ragulations will put at least 10,000 small trucking companies out of business and will put at least 5,000 small Construction Companies out of business.
 
This is all caused by the fraud at CARB and the fraudulent new Diesel Regulations.
 
There are many other small businesses that are threatened with huge losses and being forced out of business by regulations from other State agencies, many of them as fraudulent as the new Diesel Regulations by CARB.
 
The losses to the State of California again are at the very minimum in the tens of Billons of Dollars per year and more probably the losses to the State of Californai are in the hundreds of Billions of dollars per year in the form of higher prices, higher unemployment and lost production..
 
The State of California is in severe financial difficulty, and the unemployement rate in the State of California is over 10% just based on official estimates, which dramatically understate the true level of unemployment.
 
The true level of unemployment in the State of California is probably closer 25 to 30%.
 
I suspect that fraud at the State of California agencies is a substantial contributor to this high level of unemployment.
 
Many of the State Agencies like CARB could be eliminated with no loss of quality of life in the State of California and at a savings of Billions of Dollars per year to the State Budget.
 
Also, many of the regulations such as the new Diesel Ragulations are fraudulent and cost all of us enormous amounts of money in higher prices, lost production and excessive unemployment.

Fortunately there is an excellent candidate for Attorney General of The State of California.
 
That candidate is Steve Cooley. Steve Cooley has said that the will investigate and prosecute the fraud at The State of California Air Resources Board (CARB)
 
Please ask the people that you know at your church to support Steve Cooley for Attorney General.
 
Steve Cooley is the only person who has the will to investigate and prosecute the fraud at the California State Agencies.
 
Steve Cooley is currently the District Attorney who had the Mayor, City Manager and several City Council members of the City of Bell arrested for defrauding the taxpayers.
 
The Mayor of the City of Bell, the City manager and several members of the City Council had defrauded the city of Bell by giving themselves salaries in the neighborhood of $600,000 to $800,000 per year.
 
The Mayor, City Manager, and several city Council members were also collecting additional payments of several thousand dollars each per meeting for some meetings which lasted only a few minutes.
 
Steve Cooley will prosecute the fraud at the California State agencies the same way that he is prosecuting the fraud of the City Council in the City of Bell. 
 
If we can eliminate most of the fraud at the California State Agencies, that will provide a large boost tho the economy of the State of California and will save the State of California Billions of dollars per year if some of these agencies such as CARB can be eliminated.
 
In my opinion, eliminating the Fraud at the California State Agencies is critical for the financial recovery of The State of California and for all of us.
